§ 15.01.470. General description.

  • The contractor/developer shall be responsible for the protection and the restoration or replacement of any improvements existing on public or private property at the start of work or placed there during the progress of the work. The contractor/developer, sub-divider or utility company making the cut or trench shall be liable for any damage, which may result to the pavement as a result of subsidence for a period of two years from the time that the backfilling is completed.

    Existing improvements shall include but are not limited to permanent surfacing, sidewalks, curbs, gutters and ditches, driveways, culverts, fences, shallow utility lines, walls and planted areas. All improvements shall be reconstructed to equal or better conditions, in all respects, than the existing improvements removed.
